As you may be aware, the existing agreement between the EU and US on passenger PNR data transfer was struck down earlier this year by the ECJ. Intense negotiations are currently underway to broker a new agreements to accommodate the EU data protection directive strictures, and news reports are currently saying that a deal is likely before this coming Friday, October 6. The Identity Project of the First Amendment Project, one of EFF's fellow traveller organizations in the civil liberties area, is considering the feasibility of mounting a challenge to the anticipated new PNR deal. The Identity Project is looking for a European citizen travelling to the USA this week, who would have standing to challenge the transfer of their personal data to the US government, potentially in contravention of national law implementing the EU personal data protection directive and would be interested in being a plaintiff/ complainant in a legal challenge. The Identity Project has offered to work with any European citizen that is interested in this but has financial resource concerns.
